This policy (together with our Terms and Conditions and any other documents referred to in it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

 

Your consent

By using our website, you understand and agree that personal information you provide through the Website will be held on a database created and operated by us or our group of companies.

Our database is fully compliant with current DEFRA regulations and The Microchipping of Dogs Regulations. Registering your pet's keepership on a DEFRA compliant database is not proof of ownership.

When registering you will be given consent options for displaying your data if your pets microchip is searched online. We only display critical data about you and your pet and never share you address via an online search. You may update these options at any time from within your account.

We will provide veterinary practices, welfares, dog wardens and other authorised bodies with keeper details listed on a microchip for reunification purposes.

We operate a 'double opt in' system for accounts created using email to verify the details and activate the account.

If an account is created on behalf of someone else, the account will need activating for us to gain consent to display contact details if a microchip number is searched online. This is usually for reunification purposes.

Inactive accounts will incur the fees as stated in section 15 of the terms and conditions. Accounts can be activated free for 28 days after their creation.

If you set a temporary keeper, we will contact them via email and SMS to notify them they have been added as a temporary keeper. If they do not want to be listed as a temporary keeper they are invited to ask us to remove their details.

What information do we collect and why?

When you make a purchase, sign up to ‘PetChips’ or use other features on our website, you will be asked for some essential information including your title, first name, surname, postal address, email address, telephone and if applicable payment information. We are aware some users don't have email and we take this into account during the registration process.

This information is collected to help us:

  • Enable you to be reunited quickly with lost pets
  • Process your online orders including sending order confirmation and delivery information via email
  • Contact you about your order or account
  • Verify the creation of an account
  • Start the transfer of a pet to a new keeper
  • Deliver safe and secure shopping by helping to prevent and detect fraud
  • Speed up your form filling processes if you've registered online
  • Enhance your shopping experience by delivering a more personally tailored offer
  • Respond to any issues or queries via the customer service advisor teams; and/or notify you about changes to our service.

We will also automatically collect data such as dates and times of your visits to the Website and information relating to the search of a microchip. This may include your IP address, internet service provider and operating system. This information is only collected to prevent fraud and help reunify lost pets.

How we protect your information

We protect your information by:

  • Encrypting your personal information. When you place an order or access your account information, a secure server encrypts all of the information you input before it is sent to us. This protects your confidential data.
  • Keeping your information up-to-date and accurate. We need you to tell us if any of your details change, such as your name, address, contact numbers or email. You can do this by logging into your account online. This may incur a small fee.

Unfortunately, the transmission of information via the Internet is not completely secure. We cannot guarantee the security of your data transmitted to and/or through the Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to prevent unauthorized access. If a data breach does occur, we will inform all affected parties at high risk and report the breach to the authorities within 72 hours.

Data retention

The following outline the retention of data for pets and user

  • New accounts created by a user will be deleted if they are not activated within 28 days, have no pets, tags or microchips in the account, and are not registered as Scan Angels.
  • To comply with the Microchipping of Dogs act we will retain all data on inactive accounts that have pets assigned for the lifetime of the pet unless asked to remove it by you.
  • Accounts marked as 'Pet Owners' only with no active registrations (i.e., pets, ID Tags, Key Tags) will be deleted after 12 months.
  • Breeder accounts will be retained for the lifetime of any pets they have previously breed. Following this, if there are no active registrations (i.e., pets, ID Tags, Key Tags, Microchips) they will be deleted after 12 months, unless also registered as a Scan Angel.
  • Other account types will be retained unless you request, we delete your account.
  • We will remove all data relating to expired transfers after 12 months if the transfer is not accepted.
  • Temporary keeper details will be retained for the lifetime of the account unless; we are asked to remove the data, or you remove the temporary keeper from within your account.
  • We will remove all personal data relating to a 'microchip released for self-registration' if the microchip is not registered within 12 months.
  • Pets will be marked as deceased and removed from the database after the following time periods. If your pet lives longer than the below it is your responsibility to notify us. Note you can also update the status of your pet from within your account.
    • Dogs– 30 years
    • Cats – 40 years
    • Horses – 40 years
    • Rabbits – 20 years
    • Tortoises – 160 years
    • All other pets – 100 years
  • You have a right to request we remove your data at any time.

Protecting your security

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third-party databases. By accepting these terms and conditions you consent to these checks being made. All information provided by you will be treated securely and strictly in accordance with the Act.

Statement on the use and disclosure of Personal Data

We may send you by SMS, email or post, details on offers, products, reminders and services which may be of interest to you if you have given consent for us to do so. We may also telephone you to discuss order details.

We may monitor or record telephone calls to ensure our quality standards are maintained and for fraud prevention purposes. We will notify at the start of every call if it is being recorded.

We share you and your pet's critical data if the microchip is searched. We also share your critical contact data if you have consented for us to do so. We never share your address unless ordered to do so. The sharing of data is for reunification purposes.

The previous keeper, or the vet or implanter who microchipped our pet will be able to see your name, email and contact number within their PetChips Admin account. This is for reunification purposes if the new keeper can't be contacted or the data provided was inaccurate.

If a transfer has expired, we may restart the transfer at any time within 6 months.

We may disclose your personal information to third parties:

  • All of our assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets; or
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation imposed by the courts

The Website may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

Cookies

A cookie is an element of data that a website can send to your browser, which may then store it on the hard drive of your computer. Terms and Conditions

PetChips and PetChipsJo are trading names of PetChips Microchips Database.

These Terms and Conditions govern your use of the website accessed through PetChipsJo.com and any orders you place through the Website. "Us/We" refers to PetChipsJo. "You/User" refers to the User of the site, "Site" refers to https://www.PetChipsJo.com

Please read the Terms and Conditions carefully. By using the Website, you are deemed to accept the Terms and Conditions. Please note that to purchase certain goods from the Website or to use or access certain areas of the Website, you may be required to register as a 'user' of the Website and consent to the processing of your data.

1. Ownership and Intellectual Property

1.1 The Website is owned and operated by PetChipsJo, a company registered in Jordan.

1.2 The copyright and all other intellectual property rights in and to the Website and any and/or all of the material on the Website are either owned by us or are included with the permission of the owner of the rights. As a visitor to the Website, you may download a single copy of each piece of material contained on the Website for your own private viewing purposes provided you keep intact all and/or any proprietary notices.

1.3 Subject to condition 1.2 above, copying of the Website and/or any of the material contained on the Website or distribution for any commercial or business use is not permitted without our prior written consent.

1.4 No license is granted to you in these Terms and Conditions to use any trade mark whether registered or unregistered belonging to PetChipsJo. 

2. Your Account

2.1 If you use the Website, you are responsible for (1) maintaining the confidentiality of your account and your password and (2) restricting access to your computer to prevent unauthorized access to your account. You must take all necessary steps to ensure that your password is kept confidential and secure and must inform us immediately if you have any reason to believe that your password has become known to anyone else, or if your password is being, or is likely to be used in an unauthorized manner.

2.2 You must ensure that the details provided by you on registration or at any time after are correct and complete. In the case of Microchip number registration this is a legal requirement. It is also a legal requirement for all puppies to be microchipped and registered by the age of eight weeks old. The law states that all new puppy registrations MUST be to the person that bred the litter (the breeder). This includes all hobby and accidental litters. We reserve the right to report breeders that fail to comply with the legislation to the authorities. The penalty for failing to comply is a fine of up to JDs500 per puppy. To apply for an account, register microchips for third parties or add your own animal to the PetChipsJo database you must have a valid mobile telephone number and an email address registered in your own name. If the user does not have an email address, you will need to sign and return at your own expense the 'Microchip No Email Registration Form' to the address on the form. There is an administration fee payable for this option stated in section 15.

2.3 By creating an account with us you are consenting to us storing your data on our database.

2.4 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details, go the 'My Account' page. Then simply enter your email address and password and you will then be able to change the details that you originally gave. This may incur a small upgrade fee.

2.5 On the Website, we sell products for purchase only by people aged 18 or over. People aged under 18 may use the Website with supervision of a parent or guardian. The parent or guardian is required to accept these Terms and Conditions and place any orders for the person aged below 18. By using the Website, you confirm you are aged 18 or over.

2.6 Definitions; an 'Active Account' is referred to when an account has been created, verified, and a password has been set. An 'Inactive Account' is referred to when an account has not been verified or a password has not been set.

2.7 Premium Keeper Account – As a premium keeper you will have access to premium features. We reserve the right to update (add or remove) premium features and any such changes will be communicated on the Website.

2.8 'Lifetime Premium Protection' - Gives you access to premium protection for the lifetime of the pets and/or tags registered in your account.

3. Website information & availability

3.1 We take every care to ensure that the information on the Website is accurate and complete. You are advised to verify the accuracy of any information before relying on it. Further, due to the inherent nature of the Internet, errors, interruptions and delays may occur in the service at any time. Accordingly, subject to condition 13 below, the Website is provided "As Is" with warranties excluded to the fullest extent permissible by law. Subject to condition 13 below, we do not accept any liability arising from any inaccuracy or omission in any and/or all of the information provided on the Website or interruption in availability.

3.2 If a fault occurs in the service of the Website, please report it to Customer Services either by ringing +962-797-653044 or by email to support@petchipsjo.com and we will correct the fault as soon as we reasonably can.

3.3 Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

3.4 Your attention is drawn to the following information in particular:

3.4.1 Suitable Breeds. We understand that when shopping online, it can be difficult to visualize the actual size of an item, even where approximate product dimensions have been provided. Therefore, upon receipt of your order, please ensure that you are confident that the product(s) you have purchased will in fact be suitable for your pet's unique individual requirements.

4. Other promotions, vouchers & competitions

4.1 From time to time, we (or selected third parties) may include competitions, promotions, vouchers or other offers on the Website. Each such offer and or voucher shall be subject to its own express terms, however, each offer or promotion will always be subject to availability. Your statutory rights are not affected.

4.3 The refer-a-friend promotion is a 1 month registration voucher to be sent to a referrer (existing customer) when the referee (the friend) registers a pet in our database order using the referrers unique code.

Referee - A referee (friend) will get 50% off the first month of registration, The discount is only applied to microchips and implant guns. A maximum of 100 microchips can be ordered using this discount. This promotion is only available to new customers and can only be used once per customer. This offer is not valid in conjunction with any other offers. Microchips must be registered on the PetChipsJo database.

Referrer - A referrer (existing customer) will receive their 1-month free registration voucher only after the referee has purchased one of our pet microchip registration plans. Vouchers will be emailed to the referrer via our primary email address registered on their PetChipsJo account. Vouchers will be emailed on the last Friday of every month unless stated otherwise. Vouchers cannot be exchanged for cash. (

This offer is available for the selected customers only.

5. Limitations

5.1 You may not use the Website for:

5.1.1 Transmitting any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;

5.1.2 Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or codes of practice;

5.1.3 Gaining unauthorised access to other computer systems;

5.1.4 Interfering with any other person's use or enjoyment of the Website;

5.1.5 Breaching any laws concerning the use of public telecommunications networks;

5.1.6 Interfering or disrupting networks or websites connected to the Website; or

5.1.7 Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

5.2 We reserve the right to refuse to post material on the Website or to remove material already posted on the Website.

5.3 You fully indemnify us against any and/or all losses, liabilities, costs and/or expenses reasonably suffered or incurred by us, any and/or all damages awarded against us under any judgment by a court of competent jurisdiction and any and/or all settlements and sums paid by us as a result of any settlement reasonably agreed by us arising out of or in connection with:

5.3.1 Any claim by any third party that the use of the Website by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;

5.3.2 Any claim by any third party that the use of the Website by you infringes that third party's copyright or other intellectual property rights of whatever nature; and/or

5.3.3 Any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Website by you.

6. Right to suspend or cancel your registration

6.1 We may suspend or cancel your registration to the Website immediately or restrict or prevent your access to the Website at our reasonable discretion if you breach any of your obligations under these Terms and Conditions.

6.2 You can cancel this agreement at any time after giving us prior notice in writing. If you do so, you must stop using the Website.

6.3 The suspension or cancellation of your registration to the Website and/or your right to access and/or use the Website shall not affect either party's rights or liabilities.

6.4 Conditions 1, 5 and 10 of these Terms and Conditions shall survive cancellation.

6.5 We have a strict no abuse policy, so at our discretion, if we receive abusive calls or emails, we reserve the right to remove you from our database. You will be given 48 hours’ notice to make alternative arrangements.

7. Ordering goods

In addition to purchasing products online, a payment may be required to:

  • Upgrade to a Premium account and access associated benefits
  • Accept keepership of an animal that is not passed directly to a Welfare Centre
  • Register a microchip that has not been supplied by us.
  • Register microchips supplied by us on our database.

These are one-off payments of the amount shown which gives access to the services / benefits detailed for the limited set time stated.

We accept online payments by Debit, Credit Card.  Payments may be processed over the phone with a Debit or Credit Card.

Payments made will appear on your statement as 'PetChipsJo’.

When a service is paid for with a Debit or Credit Card, access to the service offered and benefits stated is immediate.

Website and telephone orders

We do not give refunds for services provided. In the event that a service is not provided as stated refunds will be credited to the original card used for the purchase and may take up to 14 days to be credited to your account.

All microchips supplied by us are pre-registered to the account of the implanter we supply them to. The microchips can only be registered by the implanter that they are originally supplied to and cannot be shared with other implanters or sold on. All microchips supplied must be implanted by a legally compliant implanter.

All microchips supplied by us must be registered on the website’s Database. A surcharge of 10JDs per microchip will be charged for any unregistered microchips after six months from the date of supply. The 10JDs surcharge will become due immediately if microchips supplied by us are unregistered on our Database and ‘swapped’ with an alternative microchip supplier.

If you purchase microchips from PetChipsJo you will receive a lifetime warranty of your pets' microchips. If any of them fail, we will replace them free of charge.

7.1 All orders placed through the Website will be subject to our acceptance of the order.

7.2 Your order constitutes an offer to us to buy or receive goods. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms the goods have been dispatched to you (the "Dispatch Confirmation"). The contract between us ("Contract") will only be formed when we send you the Dispatch Confirmation" ("Contract"). Title to the goods will pass to you on delivery to you provided payment has been made in full. The Contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation.

7.3 If you have used a promotional code to obtain a discount off the price of your order, acceptance of this order is subject to our verifying that the code has been issued to you personally and that you have complied with all the terms of the offer and qualify for the promotional code. Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.

8. Pricing, processing your orders and payment

8.1 The price of any goods will be as quoted on the Website from time to time, except in cases of obvious error. Subject to condition 8.4 below, in the event of obvious inaccuracies in the prices quoted on the Website, we reserve the right not to fulfil and/or to cancel any orders placed by you in reliance on the inaccurate prices.

8.2 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

8.3 Payment for all goods, either by credit or debit card, will be taken from your card at the time we receive your order, once we have checked your card details and stock availability. Any payment made to us will be refunded if we do not accept your order.

8.4 Whilst it is our intention to keep the Website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.

8.5 Delivery charges are clearly highlighted throughout the Website.

9. Availability and delivery

Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within 30 days of the date of the Dispatch Confirmation, unless there are exceptional circumstances such as a Force Majeure Event (see condition 16 below).

10. Consumer Rights

10.1 If you are contracting as a consumer, you may cancel any Contract between us at any time within 14 days, beginning on the day after you received the goods. In this case, you will receive a full refund of the price paid for the goods in accordance with our refunds policy set out in condition 11 below. This is in addition to your statutory rights. If you are unhappy with the goods, you have received or don't believe that they reflect those you contracted with us for then please contact us immediately as we have a duty to ensure you receive the goods you contracted with us for.

10.2 To cancel any Contract between us, you must immediately inform us by emailing our Customer Services team (sales@petchipsjo.com) and return the goods to us in accordance with condition 11 below.

11. Refunds Policy

11.1 When you return a product to us pursuant to condition 10 above (in addition to your statutory rights):

11.1.1 and where the goods are not defective, we will process the refund due to you as soon as possible and, in any case, within 14 days of the day that we receive the goods in question back from you. In this case, we will refund the price of the goods in full together with the original delivery charge (provided you return the full order to us), but not the costs you incur in returning the item to us; or

11.1.2 because you claim that the goods are defective, we will examine the returned goods and will notify you of your refund by either post, telephone or email within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 14 days of the day we confirmed to you that you were entitled to a refund for the defective goods. Goods returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us.

11.2 Please ensure that you return goods to us within 14 days of your cancellation of the Contract. This does not affect your statutory rights where the goods are faulty or not as described.

11.3 In the case of returns pursuant to condition 11.1.1 above, i.e., returns of non-defective goods, we may also reduce the amount of money refunded to you where you have used the goods beyond the handling that is necessary for you to make sure the goods are as you expected, for example the handling you would do in a shop. This is in accordance with your statutory rights.

11.4 Unless we have agreed otherwise, we will usually refund any money received from you using the same method originally used by you to pay for your purchase.

12. Risk and Title

12.1 The goods will be at your risk from the time of delivery.

12.2 Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the goods, including delivery charges. Payment for microchips supplied at no cost are deemed paid for when registered on the PetChipsJo database 'petchipsjo.com'

13. Our Liability

13.1 We warrant to you that any goods purchased from us though the Website are of satisfactory quality and reasonably fit for the purposes for which products of such kind are commonly supplied.

13.2 We shall not be responsible to you or any third party whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non-performance of our obligations under these Terms and Conditions, including such damage as may be reasonably foreseeable at the date you order the goods.

13.3 If you are contracting as a business, our liability for any claim for loss or damage shall be limited to the purchase price of the goods you purchased.

13.4 If you are contracting as a consumer, our liability for any claim for loss or damage shall be limited to three times the purchase price of the goods you purchased.

13.5 Nothing in these Terms and Conditions shall exclude or restrict our liability:

13.5.1 For death or personal injury caused by our negligence;

13.5.2 Under section 2(3) of the Consumer Protection Act 1987;

13.5.3 For fraud or fraudulent misrepresentation; or

13.5.4 For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

13.5.5. PetChipsJo Limited shall not be liable for any loss, claim, damage, nor any indirect, special, incidental or consequential damages of any kind, whether based in contract, tort, strict liability or otherwise, which arises out of (a) the use of, or inability to use, this site or content found in this site, or (b) the unauthorised access to or alteration of your transmissions or data, even if PetChipsJo  have been advised of the possibility of such damages unless resulting from the gross negligence or intentional actions of PetChipsJo.

14. Events outside our control

14.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event").

14.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control.

15. Fees

15.1 If an account is created on behalf of the owner, there are different plans: Basic plan: 10$ activation fee will be charged in addition to the monthly/yearly fee of 2$/20$ and you will receive (7 hours support daily, register up to 2 pets, assistance when your pet is lost).

Standard plan: 20$ activation fee will be charged once, in addition to the monthly/yearly fee of 4.99$/49.99$, and you will receive (24/7 support, register up to 4 pets, lost poster, ID card, Assistance in case of loss)

Platinum plan: 49.99$ activation fee will be charged once, in addition to the monthly/yearly fee of 9.99$/99.99$, and you will receive (24/7 support, register unlimited pets, ID card for each registered pet, lost poster, pet tag for the first 5 dogs, transfer keepership with 50% discount

15.2 Inactive accounts will incur a fee of 0.99$ every time we are asked to update data relating to the account.

15.5 There is a 24.99$ plus VAT transfer of keepership fee payable by the new keeper for all pets registered on our database.

15.6 Upgrade fee may be charged for users to update or rectify their account details.

16. General

16.1 The use of the Website and any Contracts formed between us are governed by English law. Any dispute arising from, or related to, such use and any such Contracts shall be subject to the exclusive jurisdiction of the courts of Jordan. We make no promise that materials on the Website are appropriate or available for use in locations outside of Jordan and accessing the Website from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Website from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws. Overseas orders (i.e. orders from outside Jordan) will not be accepted currently.

16.2 A person who is not a party to these Terms and Conditions or any Contract between us shall have no right to enforce any term of the Terms and Conditions and/or any and/or all Contracts between us under the Contracts (Rights of Third Parties) Act 1999.

16.3 If any provision of these Terms and Conditions or any provisions of any Contract between us are found to be invalid, unlawful or unenforceable by a court to any extent, such provision will to that extent be severed from the remaining provisions, which will continue to be valid to the fullest extent permitted by law.

16.4 We may assign charge or transfer any of our rights or subcontract any of our obligations under these Terms and Conditions or any Contract to any third party at any time.

16.5 You may not assign charge or transfer any of your rights or subcontract any of your obligations under these Terms and Conditions and/or any Contract between us except with our specific prior written permission in writing.

16.6 We reserve the right to revise and amend these Terms and Conditions from time to time and any such changes will be communicated on the Website. You will be subject to the policies and the Terms and Conditions in force at the time that you order goods from us, unless any change to those policies or the Terms and Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these Terms and Conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the Terms and Conditions, unless you notify us to the contrary within seven working days of receipt by you of the goods). If you do not wish to accept the new Terms and Conditions, you should not continue to use the Website. If you continue to use the Website after the date on which the changes come into effect, your use of the Website indicates your agreement to be bound by the new Terms and Conditions.

16.7 These Terms and Conditions govern the entire trading relationship between ourselves and you and will remain in force for the duration of our trading relationship.
